Notice on Implementing On-Site Performance Assessments for Key Management Personnel at Construction Project Sites

To the Construction Bureaus and Construction Engineering Bureaus of all counties (cities, districts), and to all relevant units:

In order to implement the spirit of the “Opinions of the State Council on Upholding Scientific and Safe Development and Promoting the Continuous Stabilization and Improvement of Work Safety” (Document No. 40 of 2011 issued by the State Council), the “Notice of the Ministry of Housing and Urban–Rural Development on Issuing the Interim Measures for On-Site Supervision by Heads of Construction Enterprises and Project Managers” (Document No. 111 of 2011 issued by the Ministry of Housing and Urban–Rural Development), and the “Notice of the Provincial Department of Housing and Urban–Rural Development on Implementing On-Site Performance Assessments for Key Management Personnel at Construction Sites and Promoting Coordination between Construction Sites and Workplaces” (Document No. 57 of 2012 issued by the Jiangsu Provincial Department of Housing and Urban–Rural Development), and in light of the actual conditions in our city, it has been decided, after deliberation, to carry out on-site performance assessments for key management personnel at construction sites of projects within the urban area. This will be achieved through the use of an LBS positioning system to manage the on-site presence of construction-site management personnel, conduct safety-assistance analysis for ongoing construction projects, and enable real-time exchange and sharing of information and data among safety supervision and management systems, thereby further promoting coordination between construction sites and workplaces and establishing a long-term management mechanism for ensuring that enterprises fulfill their primary responsibility for work safety. The specific requirements are hereby notified as follows:

  I. Assessment Methods and Organization

The assessment utilizes an LBS wireless positioning system, leveraging mobile devices to perform wireless location tracking of key on-site management personnel within the construction site area, and automatically collects, aggregates, and analyzes data on their presence and absence from work.

The Construction Bureaus and Construction Engineering Bureaus of each county (city, district) are responsible for conducting on-duty assessments of key management personnel at construction project sites within their respective jurisdictions. In the urban districts (Chongchuan and Gangzha), such on-duty assessments shall be organized and implemented by the Nantong Municipal Construction Safety Production Supervision Station. For the construction project sites in the Municipal Economic and Technological Development Zone, the Sutong Science and Technology Industrial Park, and Tongzhou District, the on-duty assessment of key management personnel shall be conducted in accordance with the on-duty assessment management measures applicable to the urban districts.

II. Scope and Subjects of Assessment

All new construction, renovation, and expansion projects for building works and municipal infrastructure within the administrative boundaries of Nantong City shall be subject to performance assessment. The key management personnel at construction project sites who are included in the on-site performance assessment comprise: one client representative dispatched by the project owner; the head of the construction enterprise serving as the shift supervisor; the project manager of the ongoing construction project; the project’s full-time safety management personnel; and the chief supervising engineer of the project.

In principle, the on-duty assessment of key management personnel at construction sites in the urban districts (Chongchuan and Gangzha) shall be carried out in three steps:

  1. Pilot Phase (June–July 2012).

All ongoing construction projects that have been nominated as provincial-level civilized construction sites but have not yet undergone assessment shall commence LBS-based personnel positioning and on-site attendance verification by the end of July 2012.

  2. Promotion Phase (August–December 2012).

Building on the pilot program, by the end of December 2012, LBS-based personnel positioning and on-site attendance verification shall be universally implemented for all ongoing construction projects, government-invested projects, and affordable housing projects that have applied for municipal-level civilized construction site designation but have not yet undergone assessment.

  3. Full Implementation Phase.

On the basis of promoting and applying this system, effective July 1, 2012, all newly commenced government-invested projects, affordable housing projects, and projects seeking designation as provincial- or municipal-level model construction sites shall uniformly implement LBS-based personnel positioning and on-site attendance assessment; and effective January 1, 2013, LBS-based personnel positioning and on-site attendance assessment shall be fully implemented across all newly commenced construction projects.

The Construction Bureaus and Construction Engineering Bureaus of all counties (cities and districts) shall, in accordance with the requirements of the Provincial Department and the spirit of this notice, systematically advance the implementation of on-site performance assessments for key management personnel at construction project sites.

  III. Job Requirements

  1. The Construction Bureaus and Construction Engineering Bureaus of all counties (cities and districts), as well as all relevant units, shall enhance their awareness, fully understand the purpose and significance of implementing on-site attendance assessments for key management personnel at construction sites, strengthen organizational leadership over assessment work, make careful plans, vigorously advance implementation, and ensure the smooth execution of the assessment process.

  2. The legal representative of a construction enterprise and the project manager are, respectively, the primary persons responsible for work safety at the enterprise level and for individual construction projects, and they shall bear overall responsibility for implementing the assessment system for these projects. Construction enterprises shall establish an on-site assessment system that clearly defines the scope of work, delineates responsibilities and authorities, and sets out assessment-based rewards and penalties, so as to effectively eliminate safety hazards.

  3. All responsible entities shall strengthen the implementation and oversight of the performance appraisal system to ensure that on-site attendance rates comply with relevant requirements. The head of the construction enterprise shall conduct on-site inspections at least 25% of their working days each month. The project manager, the project’s full-time safety management personnel, and the chief supervising engineer shall each spend no less than 80% of the current month’s construction period on site.

  4. Any construction project that, in accordance with the requirements, should have been included in the assessment but failed to participate shall have its eligibility for provincial- and municipal-level “Civilized Construction Site” designation and for consideration for all types of awards revoked. For projects within the scope of the assessment, if any assessed personnel fail to participate or do not meet the assessment requirements, the construction authorities of each county (city, district) shall issue public criticism and record such instances in the enterprise’s integrity file. In cases where repeated absence of assessed personnel and inadequate safety management result in work safety accidents, the responsible entities and individuals shall be held strictly and severely accountable in accordance with the law.
